To the extent allowable by law, NationaLease will not be liable for any damages or injury, including but not limited to, special or consequential damages that result from the use of, or the inability to use, the materials in this site or any site which is linked to this site, even if there is negligence on the part of NationaLease or an authorized NationaLease representative has been advised of the possibility of such damages, or both. The total liability resulting from all losses, damages, and causes of action will not be greater than the amount paid by the user to access this site.

Passwords and Security
You are responsible for maintaining the confidentiality of your password and account and for logging out of your account at the end of each session. You are fully responsible for all activities that occur under your password or account. You agree to notify NationaLease immediately of any unauthorized use of your password or account or any other breach of security. NationaLease will not be liable for any loss or damage arising from your failure to comply with this section.
You or NationaLease may terminate this agreement at any time. You may terminate this agreement by destroying: (a) all materials obtained from all NationaLease sites, and (b) all related documentation and all copies and installations (together, "Materials"). The NationaLease may terminate this agreement immediately without notice if, in its sole judgment, you breach any term or condition of this agreement. Upon termination, you must destroy all Materials.
These Terms and Conditions will be governed and interpreted pursuant to the laws of the state of Illinois and the United States of America, notwithstanding any principles of conflicts of law. If any part of these terms and conditions is unlawful void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. NationaLease Trademark Usage Guidelines
NationaLease's Philosophy on Trademarks
NationaLease's trademarks, service marks and logos including those used by NationaLease in the future (collectively the "Logos"), are NationaLease's intellectual property. They are important and valuable assets of the association and must be used properly. The strength of NationaLease's corporate identity is preserved through maintaining the integrity of the Logos' design elements and consistency of use. The quality and nature of NationaLease's services are identified by its Logos. As such, all references to NationaLease and use of the Logos must be truthful, fair, and not misleading, and comply with these Guidelines, which may be modified by NationaLease from time to time in NationaLease's sole discretion. It is essential that these Guidelines be properly followed in internal and external communications, documents and electronic messages.
To Whom Do These Guidelines Apply?
These Guidelines apply to NationaLease employees, NationaLease Members, NationaLease Trailer Members, NationaLease Logistics Members, NationaLease Developing Members, outside vendors and other third parties.
Using NationaLease's Trademarks, Logos and Taglines
Unless otherwise set forth in these Guidelines, written approval must be given by NationaLease to use any NationaLease Logos. All use must be in accordance with the rules, instructions and the limited license contained in these Guidelines.
- Only Members who are in good standing may use the NationaLease Logo. Once approved as a Member, Members may use the NationaLease Logo on stationery, letterhead, business cards, advertisements, general business correspondence, outside signage, upon equipment and their official Web sites. The privilege to use any NationaLease Logo is immediately terminated if a Member is terminated. Unauthorized use of the Logos may result in legal action.
- NationaLease Logistics Members may not use NationaLease Logos in any form or for any purpose.
- NationaLease Trailer Members may use the NationaLease Trailer Member Logo.
- NationaLease Developing Members may use the NationaLease Developing Member Logo.
- The appropriate trademark symbol and trademark acknowledgment of NationaLease's ownership of the Logos in question must be used.
- The NationaLease Logos may not be modified in any way. Their use must be exactly as depicted on the instructions, including same font size, colors, spacing and proportions.
- Unlicensed use of NationaLease's Logos is not permitted. Any use of NationaLease Logos except as authorized in these Guidelines requires written permission from NationaLease.
Provided that you are a Member of NationaLease in good standing or Developing Member or Trailer Member or have obtained written permission from NationaLease in strict compliance with NationaLease's Trademark Usage Guidelines, NationaLease grants you a limited, revocable, non-exclusive, non-sublicenseable license to use certain NationaLease Logos. NationaLease may request that you discontinue using the Logos and/or substitute new or different Logos, in which case you will promptly comply. You must not take any action inconsistent with or challenge NationaLease's ownership of the Logos and NationaLease owns and is entitled to claim any benefits accruing from use of the Logos. You must not register or attempt to register any Logos. Title to and ownership of the Logos and all goodwill associated with the Logos shall at all times remain with NationaLease. You must use the Logos exactly in the form provided and in conformance with NationaLease's Trademark Usage Guidelines.
NationaLease disclaims all liability to you, your clients, customers and any other third party, relating to the Logos, your use of the Logos, or the goods or services you provide. You agree to indemnify, defend and hold NationaLease harmless from any and all costs, damages, expenses or losses of any nature (including reasonable attorney's fees) resulting from any claim arising out of your use of the Logos. The Logos are provided AS-IS without warranty of any kind, whether express or implied, including any implied warranty of noninfringement or regarding the validity of NationaLease's rights in any country. NationaLease disclaims any and all warranties that may be otherwise implied by applicable law.
In no event shall NationaLease be liable for any direct or indirect damages, including, but not limited to those for lost profits or business interruption, speculative, consequential, incidental, special, punitive or exemplary damages, specifically excluding same to the extent awarded pursuant to a third party infringement claim, irrespective of whether the claim is in contract or tort and/or NationaLease has advance written notice of the possibility of such damages.
Notwithstanding the foregoing, in no event shall NationaLease's liability for your use of the Logos exceed $5. Some states do not allow exclusion of consequential or incidental damages, so some of the foregoing may not apply to you.
